These Terms and Conditions (“Terms”) govern your access to and use of the website www.geargig.com and the GearGig mobile application (collectively referred to as the “Platform”), along with all services made available through it (“Services”).
These Terms, together with our Privacy Policy and any additional guidelines, policies, or notices issued from time to time (“Additional Terms”), form a legally binding agreement between GearGig Technology Private Limited, having its registered office at Greater Noida West, India (“GearGig”, “we”, “us”, or “our”), and any individual or entity accessing or using the Platform (“you” or “User”).
By accessing or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must refrain from using the Platform.
1. NATURE OF SERVICES
GearGig operates as a digital marketplace that enables users to discover, connect with, and engage independent service providers for a variety of industrial, technical, and professional services, including but not limited to inspection, manpower supply, prototyping, sourcing, and business support services.
GearGig itself does not perform or deliver these services. All services are rendered by independent third-party professionals (“Service Providers”) who operate on their own account. GearGig does not employ, control, or supervise Service Providers and shall not be deemed responsible for the quality, safety, or completion of any services provided by them.
The role of GearGig is limited to facilitating interactions, enabling bookings, and supporting payment processing between Users and Service Providers.
2. ELIGIBILITY AND ACCOUNT REGISTRATION
To access certain features of the Platform, you may be required to create an account by providing accurate and complete information. You must be at least 18 years old to register and use the Services.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. Any unauthorized use must be reported to us immediately. GearGig shall not be liable for any loss resulting from unauthorized access to your account.
3. BOOKINGS AND SERVICE ENGAGEMENT
Users may request services by selecting the desired offering, providing relevant details, and choosing an available time slot. Once a request is placed, confirmation will be shared through the Platform or via electronic communication.
GearGig will make reasonable efforts to match your request with a suitable Service Provider. However, we do not guarantee availability at all times. In case of cancellations or unavailability, an alternative may be suggested.
Any agreement for actual service delivery is strictly between you and the Service Provider.
4. PRICING AND PAYMENTS
The total amount payable may include:
- Charges for services rendered by the Service Provider
- Platform service or facilitation fees charged by GearGig
- Additional costs such as materials, travel, or urgent service charges
Payment can be made through available modes such as UPI, debit/credit cards, net banking, digital wallets, or cash (where applicable). GearGig may use third-party payment processors, and such transactions will also be governed by their respective terms.
All pricing is subject to change based on location, service complexity, and demand conditions. Payments once made are generally non-refundable unless explicitly stated otherwise.
5. USER CONDUCT AND OBLIGATIONS
You agree to use the Platform responsibly and in compliance with applicable laws. You must:
- Provide accurate information
- Maintain respectful conduct towards Service Providers
- Ensure a safe working environment for service delivery
Any misuse, abusive behavior, or violation of these Terms may result in suspension or termination of your access to the Platform.
You also agree not to bypass the Platform by directly engaging Service Providers introduced through GearGig for similar services outside the Platform.
6. USER-GENERATED CONTENT
You may have the ability to post reviews, ratings, or feedback on the Platform. By submitting such content, you grant GearGig the right to use, reproduce, and display the content for operational and promotional purposes.
You agree that your content will not be unlawful, misleading, defamatory, or infringe any third-party rights. GearGig reserves the right to remove or moderate any content at its discretion.
7. DATA PRIVACY
Your personal data will be collected and processed in accordance with our Privacy Policy. This may include sharing data with Service Providers, affiliates, or regulatory authorities as required to deliver services or comply with legal obligations.
8. THIRD-PARTY SERVICES
The Platform may contain integrations or links to third-party services. GearGig does not control such services and is not responsible for their content, accuracy, or performance. Your use of third-party services is at your own risk and subject to their terms.
9. INTELLECTUAL PROPERTY RIGHTS
All content, trademarks, technology, and materials available on the Platform are owned by or licensed to GearGig. You are granted a limited right to access and use the Platform for personal or business purposes, subject to these Terms.
You may not copy, reproduce, distribute, or exploit any content without prior written permission.
10. DISCLAIMERS
The Platform and Services are provided on an “as available” basis without any warranties, express or implied. GearGig does not guarantee:
- Availability of services at all times
- Accuracy of service descriptions
- Quality or suitability of Service Providers
Users acknowledge that they engage Service Providers at their own discretion and risk.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, GearGig shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or Services.
In any case, GearGig’s total liability shall not exceed INR 10,000 or the amount of service fee earned by GearGig in relation to the relevant transaction, whichever is lower.
12. INDEMNIFICATION
You agree to indemnify and hold harmless GearGig, its directors, employees, and affiliates from any claims, damages, or losses arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.
13. TERMINATION
GearGig reserves the right to suspend or terminate your access to the Platform at any time in case of breach of these Terms or for any legitimate business reason.
You may discontinue use of the Platform at any time.
14. GOVERNING LAW AND DISPUTES
These Terms shall be governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts located in New Delhi.
Disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996, by a single arbitrator appointed by GearGig. The language of arbitration shall be English.

16. GENERAL PROVISIONS
GearGig reserves the right to update or modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
If any provision of these Terms is found invalid, the remaining provisions shall continue to be enforceable.
GearGig may assign its rights and obligations without prior notice.
